Quy định của pháp luật về thẻ tạm trú

Thẻ tạm trú được coi là loại giấy tờ duy nhất do cơ quan nhà nước có thẩm quyền của Việt Nam cấp cho người nước ngoài được phép tạm trú tại Việt Nam theo pháp luật hiện hành.

Để được cấp thẻ tạm trú, người nước ngoài phải đáp ứng các điều kiện sau:

– Tuân thủ các quy định về xuất nhập cảnh của Việt Nam như có hộ chiếu và thị thực;

– Sở hữu tạm trú hợp pháp: Việc tạm trú của người nước ngoài tại Việt Nam sẽ được xác định bằng các giấy tờ chứng minh việc sử dụng hợp pháp. Trường hợp có giấy phép xác nhận khả năng cho người nước ngoài thuê; đăng ký tạm trú và cấp giấy tạm trú, chứng nhận tạm trú;

Hiện nay, có hai nhóm đối tượng chính được phép cấp thẻ tạm trú tại Việt Nam:

– Người nước ngoài làm việc tại cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện tổ chức quốc tế thuộc Liên hợp quốc, cơ quan chính phủ tại Việt Nam và gia đình gồm vợ/chồng, con dưới 18 tuổi và người giúp việc gia đình dài hạn. Sẽ có những thành viên khác. được cấp ký hiệu NG3;

Thời hạn tạm trú được quy định như sau:

– Tính năng LD, PV1 có thời hạn không quá 2 năm.

Ngoài ra, trong trường hợp thẻ tạm trú hết hạn, có thể xin cấp lại và tái xuất cảnh thông qua cơ quan nhà nước có thẩm quyền.

Thẻ tạm trú tiếng Anh là gì?

Thẻ tạm trú tiếng anh gọi là “temporary residence card” hay gọi tắt là “TRC”. Đây là loại giấy tờ cho phép người nước ngoài tạm trú tại một quốc gia trong thời gian nhất định mà không phải xin thị thực liên tục. Thẻ tạm trú thường được cấp cho người nước ngoài đang sinh sống, làm việc tại một quốc gia, nhưng không phải là công dân của quốc gia đó. Tùy theo quy định của mỗi quốc gia mà thời hạn và quyền lợi của thẻ tạm trú có thể khác nhau.
